The Federal Government has officially closed its case against Nnamdi Kanu, the detained leader of the proscribed Indigenous People of Biafra (IPOB), in the ongoing trial on terrorism-related charges.
At Thursday’s proceedings before Justice James Omotosho of the Federal High Court in Abuja, the government’s lead counsel, Chief Adegboyega Awomolo (SAN), made the announcement following the testimony of the fifth and final prosecution witness, identified only as “EEE” for security reasons.
EEE was led in evidence and cross-examined by Kanu’s defence counsel, Onyechi Ikpeazu (SAN), during the session.
Speaking after the cross-examination, Awomolo told the court that the prosecution had presented enough evidence, including recorded broadcasts by Kanu, to support the charges brought against him.
“Having called five witnesses and tendered substantial documentary evidence, the prosecution is satisfied it has made its case,” Awomolo said. “I therefore close the case.”
In response, Kanu’s lead defence counsel, Chief Kanu Agabi (SAN), informed the court of the defence team’s decision to file a no-case submission, implying that they believe the prosecution has not established a prima facie case to warrant the continuation of the trial.
Justice Omotosho acknowledged the statement and is expected to set a date for the hearing of the no-case submission.
The case against Kanu, who has remained in custody since his re-arrest in 2021, stems from charges of terrorism, treason, and inciting violence, among others, over his alleged role in the agitation for Biafra’s secession from Nigeria.
